정규 대학 재학 중인 자녀도 더 이상 동반 자녀에 포함되지 않습니다. 재정적으로 부모에게 의족하고 학업 중일지라도 19세 이상이면 동반 가족으로서 자격에 해당하지 않게 됩니다.

다만, 육체적, 정신적 조건 때문에 재정적으로 부모에게 의존하고 있으며 스스로 경제적 부양을 할 수 없는 경우에는 나이에 상관없이 동반 자녀로 인정됩니다.

캐나다 이민법이 규정하는 동반 자녀의 정의는 다음과 같습니다.

- 19세 미만의 미혼자녀이거나,

- 19세 이후에도 재정적으로 부모에게 의존하고 있으며 육체적, 정신적 조건 때문에 스스로 경제적 부양을 할 수 없는 경우

1. Paragraph (b) of the definition “dependent child” in section 2 of the Immigration and Refugee Protection Regulations(see footnote 1) is replaced by the following:

·         (b) is in one of the following situations of dependency, namely,

o    (i) is less than 19 years of age and is not a spouse or common-law partner, or

o    (ii) is 19 years of age or older and has depended substantially on the financial support of the parent since before the age of 19 and is unable to be financially self-supporting due to a physical or mental condition.
